Feeding America OTC Hub Privacy Statement
Effective Date: June 3, 2016
Your privacy is important to Feeding America OTC, and its members (collectively, “Feeding America OTC,” “OTC”, “us,” “our,” and “we”). This Privacy Statement describes our information and privacy practices that apply when you use the Feeding America OTC Hub website located at www.otchub.org (the “Site”), as well as information we collect through offline contacts we may have with you. As used in this Privacy Statement, the term “you” refers to anyone who simply browses the Site, any individual user who registers for an individual account that is part of an organizational membership, any organizational administrator who manages an organizational membership and the organization itself, or any other user of the Site.
PLEASE READ THIS PRIVACY STATEMENT BEFORE YOU USE THE SITE. Your use of the Site signifies that you have read and agree with all of the terms of this Privacy Statement and consent to the collection and use of your personal information by Feeding America OTC, as described in this Privacy Statement. If you do not agree with any part of this Privacy Statement, do not use the Site. If you are acting on behalf of an entity, you represent that you have full authority to bind your entity to this Privacy Statement. If you do not have such authority, do not use the Site.
CHANGES TO THIS PRIVACY STATEMENT. We reserve the right to revise this Privacy Statement at any time. We will post any revised Privacy Statement here. We may also notify you via email of significant changes, provided we have your current email address, or require that you agree to such changes when you next log into your account. Your use of the Site following such revision constitutes your acceptance of and agreement to the terms of this Privacy Statement as amended, and the revisions will apply to the information collected on and after the date on which we post the revised Privacy Statement.

1. Information Collected
(a) Personally Identifiable Information
In order to access most areas of the Site, to create an account on the Site, and to participate in the online services we provide, you will be required to provide Personally Identifiable Information (described below). YOU ARE NEVER UNDER ANY OBLIGATION TO PROVIDE YOUR PERSONALLY IDENTIFIABLE INFORMATION. However, if you do not provide Personally Identifiable Information, you will not be able to use most features of the Site. When you do provide your Personally Identifiable Information, you are authorizing us to use that information in accordance with the terms of this Privacy Statement and to store your Personally Identifiable Information on our servers located in the United States.
Personally Identifiable Information collected on the Site may consist of information including, but not limited to:
(i) Your full name;
(ii) Your home or business address, billing address, phone number, email address, other information that could be used to contact you via mail, in person, or online or to identify you personally;
(iii) Your photo to associate with your account;
(iv) Financial information such as credit card information;
(v) Your username and password and answers to security questions;
(vi) Demographic information (such as your zip code);
(vii) Details regarding your organization and its products and services;
(viii) Information you input into any message box, open text box, or search box, such as if you fill out a form to contact us through the Site or otherwise enter information into any open comment box;
(ix) Information or messages you send to other Site users; and
(x) Any other information you actively enter into the Site.
Personally Identifiable Information may be provided by you to us in several ways, including but not limited to, when you contact us through the Site; register as a vendor to have your products or services listed on the Site; fill out and submit a form to us through the Site; create, access, and use your member account through the Site; register to use and use a message board; and/or if you communicate with us via email or phone call.
(b) Setting up Your Account
If you are an individual member associated with an organization, your organizational administrator will initially set up your account by providing us your name, email address, and username. Your organizational administrator will then email you your username and temporary password, along with a link to an account log in page. Once you log in, you will then be taken to a page to change your password.
(c) Financial Information
When you make any payments through our Site, you will provide your financial information to our third-party payment processor Authorize.Net (see information about Authorize.Net here: http://www.authorize.net/solutions/merchantsolutions/onlinemerchantaccount/?gclid=CP3Q9vui18sCFZNgfgodH6MKsQ). Your credit card information will be used to complete the transactions you initiate. See more information below in Section 3(c) regarding use of your financial information.
(d) Your Public Identity on the Site
If you have an account on the Site, the following information will be displayed through the Site, available to other Site users (even those who are not associated with your organization), and connected to your activity on the Site, such as blog posts, message boards, and private messages:
(i) All information associated with your profile, such as your username, photo, name, gender, email address, online status, date you joined as a member, last time you visited, profile signature (which is something you have the option of including in your profile), and other similar information; provided, however, that your password will not be made available to other Site users;
(ii) Products and services available in the hunger relief industry that you use;
(iii) Information about your organization and information included in the member directory (if you choose to be listed in the member directory); and
(iv) All images, videos, opinions, and other content you post on the blog, message board, or other public areas of the Site.
You acknowledge and agree that such information, images, videos, opinions, and other content may be read, collected, used, or disclosed by other Site users. We are not responsible or liable for any such collection, use, or disclosure.
(e) Private Messages
If your administrator has enabled the private message feature for your message board, you may be able to send private messages to other Site users. It is possible, however, that your administrator may be able to view your sent and received messages.
(f) Automatically Collected Information
As soon as you access and use the Site, we automatically track, collect, and store information about your visit such as:
(i) Date and time of visit and duration of visit;
(ii) Site traffic patterns and clickstreams;
(iii) Type of web browser used, operating system/platform used;
(iv) Your IP address or mobile device ID;
(v) The website from which you linked to the Site.
This information allows us to track what visitors to the Site are looking at most frequently so we can analyze trends; recognize and deliver more of the desired features, products and services; and continually improve the performance and functionality of the Site. Unless prohibited by law, this Automatically Collected Information may be combined with Personally Identifiable Information you have provided.
2. How We Collect Automatically Collected Information
We may use a feature of your internet browser called a “cookie” (a small file automatically placed on your hard drive, which assigns you a unique, random number that acts as a sort of anonymous ID) to facilitate Site navigation and internet sessions. Standing alone, a cookie does not identify Personally Identifiable Information of a user; rather, it identifies the computer or device that a user uses to access the Site. Unless you choose to identify yourself to us, such as by filling out a form or creating an account, you remain anonymous to us when browsing the Site.
Regardless of whether you have an account on our Site, when you visit our Site, we use session cookies to collect Automatically-Collected Information as you browse and use the Site. Session cookies are removed from your hard drive when you close your browser or otherwise end your session on the Site.
If you have an account on the Site, each time you log into your account, we use a persistent cookie containing encrypted information to allow us to uniquely identify you and to process your online transactions and requests. Persistent cookies remain on your hard drive even after you close your browser or otherwise end your session on the Site.
Most browsers automatically accept cookies, but you can disable the acceptance of cookies at any time by changing the preferences in your browser. Please refer to your browser for information on how to disable and control cookies. If you choose to disable cookies on your browser, you will not be able to use most features of the Site and/or some features or services may not function as well.
(b) IP Addresses and Device IDs
When you visit the Site, we collect your IP address and/or mobile device ID to track and aggregate Automatically Collected Information. For example, we use IP addresses to monitor the regions from which our Site users navigate the Site. We also collect IP addresses and device IDs from users when they log into their accounts on the Site in order to confirm the applicable user’s identity.
(c) Third Party Cookies and Website Analytics
We may engage third parties to track and analyze usage and volume statistical information from users of the Site. You may encounter cookies from these third parties on certain pages of the Site, which we have allowed. The information provided to these third parties does not include Personally Identifiable Information; rather, these third parties only collect Automatically Collected Information. We use the information collected from these service providers to find usability problems to make the Site easier to use.
3. Use of Collected Information
(a) Use of Personally Identifiable Information
We may use your Personally Identifiable Information to create an account for you; to respond to your information requests or requests for coaching services; to process payments you authorize through our Site; to otherwise complete your actions and requests made through the Site; or to contact you regarding the Site or your account or transactions made through the Site or to provide required notices. See other sections of this Privacy Statement for more information on how we use your Personally Identifiable Information.
(b) Use of Personally Identifiable Information for Marketing Purposes
We may use your Personally Identifiable Information to contact you to provide information about products or services that may be of interest to you; and to provide information regarding Feeding America OTC and upcoming events, new products or services, and other general information about our services.
You will be given the opportunity to opt-out of receiving future marketing notices/ emails. You may also opt-out of receiving future marketing notices by contacting us at firstname.lastname@example.org. If you request that we not contact you for marketing purposes (either by using the unsubscribe mechanism or by sending us an email), we reserve the right to contact you for non-marketing purposes relating to your use of the Site.
(c) Use of Financial Information
Our payment processor, Authorize.Net will use your financial information and other Personally Identifiable Information to process your payments made through the Site. Feeding America OTC will never receive your financial information, however; Feeding America OTC will include a profile ID as part of your account information stored on our servers, which profile ID is associated with your financial information stored by Authorize.Net. Authorize.Net provides data encryption during the payment process. Note that Authorize.Net will store your financial information and other Personally Identifiable Information for future payments. You will have to contact Authorize.Net directly if you ever want Authorize.Net to remove your financial information and other Personally Identifiable Information from their databases. When your financial information and other Personally Identifiable Information is in the possession of Authorize.Net, your information is subject to Authorize.Net’s privacy statement, located here: http://www.authorize.net/company/privacy/
(d) Automatically Collected Information
We collect Automatically Collected Information in an effort to ensure that our Site will appear and function appropriately on your computer, to help us improve the Site, and so we may determine which website referred you to our Site. We use your IP address or mobile device ID to help identify you. We may also use Automatically Collected Information to track what our Site users are looking at most frequently so we can recognize and deliver more of the desired features, products, and services. See other sections of this Privacy Statement for more information on how we use your Automatically Collected Information.
(e) General Use
We may use both Automatically Collected Information and Personally Identifiable Information to help diagnose problems with the Site; to analyze statistical use patterns and demographic data; and to improve our Site and services.
4. Who Has Access to the Information We Collect?
Except in the circumstances stated in this Privacy Statement, we will not sell or otherwise transfer or disclose your Personally Identifiable Information to any third party.
We may also share de-identified aggregated Automatically Collected Information without restriction.
(a) Third-Party Service Providers
We may provide your Personally Identifiable Information and Automatically Collected Information to third parties that provide us with services to the extent necessary and appropriate, in our discretion, to perform certain marketing or Site related services on our behalf (e.g., hosting and providing operational support for the Site, improving Site related services and features, directing mailings, fulfilling orders, conducting website analytics, etc.).
(b) Third-Party Payment Processors
We use the third-party intermediary Authorize.Net to manage payment processing. See additional information above regarding Authorize.Net.
(c) Other Site Users
See information above regarding what Personally Identifiable Information other Site users will see.
(d) Organizational Administrators
If you are an individual with an account that is connected to an organizational member, you should assume that your organizational administrator can see all information associated with your account and your Site activity.
(e) Public Areas of Site
The Site contains one or more areas where users can post content that will be viewed by other Site users. Further, the Site allows private messaging to other Site users. When you voluntarily disclose Personally Identifiable Information on these areas for public viewing or to other Site users, the information may be collected, stored, used, and disclosed by other users of the Site. Such activities are beyond our control, and we shall have no responsibility for or liability regarding the protection or security of such information.
(f) Merger, Acquisition, or Sale
We may transfer any and all Personally Identifiable Information and Automatically Collected Information to a third party (whether affiliated or not), in the event of a sale or transfer of assets or other disposition of all or any portion of our business. In this event, we will, if allowed, use reasonable efforts to notify you when your Personally Identifiable Information and Automatically Collected Information is transferred to any third party under this paragraph by posting such notice on the Site and/or by contacting you via the Personally Identifiable Information you have provided us, if any.
(g) Required by Law
Notwithstanding anything to the contrary in this Privacy Statement, we may also use and/or disclose Personally Identifiable Information and Automatically Collected Information, to any third party, without your consent and without notice to you, if we believe we are legally obligated to do so; if we believe disclosure is necessary to protect, establish, or exercise our legal rights or defend against legal claims; or if we believe disclosure is necessary to protect our other customers, third parties, or our employees, property, or business.
5. Securing Collected Information
We use commercially reasonable physical, electronic, and managerial security measures to assist in protecting against the loss, misuse, and unauthorized alteration of Personally Identifiable Information that is under our control. Unfortunately, no data storage system, or system of transmitting data over the Internet, can be guaranteed to be 100% secure. As a result, we cannot guarantee the security of our servers, the means by which Personally Identifiable Information is transmitted between your computer and our servers, or any Personally Identifiable Information provided to us or to any third party through or in connection with the Site.
6. Updating and Correcting Personal Information
You or your organizational administrator may update or change your Personally Identifiable Information associated with your account by logging into your account and editing your account information or by sending an email request to email@example.com. If you have otherwise given us Personally Identifiable Information through the Site but you do not have an existing account, you may update or change your Personally Identifiable Information by sending an email request to firstname.lastname@example.org. Please note that your account and all features of the Site may not function properly if you remove or request that we remove any or all of your Personally Identifiable Information.
If you want to close your account, please contact us at email@example.com.
If you request that your Personally Identifiable Information be changed or deleted from our databases and/or that we close your account, we will use commercially-reasonable efforts to remove your Personally Identifiable Information from our databases, but see Section 7 regarding why we may still maintain some information.
7. Retention and Storage
See information above in Section 3(c) for information regarding how long our payment vendor may retain your financial information.
We may retain all other Personally Identifiable Information and Automatically Collected Information in our databases until you ask or your organizational administrator asks us to remove your information from our databases, unless applicable laws require otherwise. Note that even after you ask or your organizational administrator asks us to remove your information from our databases, it may be impossible to remove some information, such as information tracked in our web server log files and information that may reside in backup files. We may also retain Automatically Collected Information even after you or your organizational administrator requests that we remove your information from our databases, for use in the aggregate and to analyze and improve the Site. Further, even after you or your organizational administrator requests that we remove your information from our databases, we may retain Personally Identifiable Information and Automatically Collected Information to comply with any applicable law, rule, regulation, or guideline; to prevent fraudulent activity; to protect ourselves against liability; and to allow us to enforce our contractual or other rights and to pursue available remedies and limit any damages we may sustain.
8. Links to Third-Party Websites, Products, and Services
This Privacy Statement applies only to the Personally Identifiable Information and Automatically Collected Information collected through the Site. The Site may contain links to other websites (“Linked Sites”), products, and services that are not owned or controlled by us. We are not responsible for and have not reviewed the privacy practices of the Linked Sites, or the owners or operators of the Linked Sites, products, or services.
9. Intended Users of the Site
The Site is intended for adults only. By accessing, providing information through, or otherwise using the Site, you affirm (i) that you are at least eighteen (18) years old, or that you are between the age of thirteen (13) and seventeen (17) and possess legal parental or guardian consent to use the Site and provide information through the Site (to purchase services or product from the Site, you must be at least eighteen (18) years old); (ii) that you are a United States resident; and (iii) that you have authority to agree to this Privacy Statement and are competent and capable of understanding and complying with this Privacy Statement.
The Site is not directed to children under the age of thirteen (13), and we will not knowingly collect any Personally Identifiable Information from children under the age of thirteen (13) and will not knowingly contact children under the age of thirteen (13) for marketing purposes.
If any part of this Privacy Statement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will not affect the validity and enforceability of any other provision.
